Term of Serivce

1. Acceptance of Order

By placing an order with Coming Inflatables, Inc., you, the Buyer, agree to the terms and conditions outlined in this document. These terms and conditions are considered the primary agreement and supersede any other terms, except when specifically agreed to in writing by Coming Inflatables, Inc. We do not accept responsibility for typographical or clerical errors in quotations, orders, or publications.

2. Payment

Payment for Coming Inflatables, Inc. products is subject to the following terms:

  • A deposit of 30% is required to secure a production slot.
  • For custom orders, a 50% deposit is necessary.
  • Production commences upon receipt of the deposit.
  • Final payments must be made at least 48 hours before the scheduled ship date.
  • It is the responsibility of the customer to ensure timely final payments.
  • All prices are Net. F.O.B. Los Angeles. Sales tax is charged as applicable
  • Accepted payment methods include certified funds, money order, bank wire transfer, cash, or credit card.
  • Coming Inflatables, Inc. reserves the right to withhold production when doubts arise about the ability to pay.

3. Shipping

  • The shipping date is estimated based on the production schedule.
  • Delays in deposit submission or artwork may affect the shipping date.
  • Coming Inflatables, Inc. selects carriers and may pass on discounts to customers.
  • If the customer does not specify a carrier, we will use our best judgment.
  • Shipping is usually F.O.B. carrier at Coming Inflatables, Inc.'s factory in City of Industry, California.
  • Partial shipments may occur only after full payment.
  • Coming Inflatables, Inc. is not responsible for damage during shipping, and such issues should be resolved following the carrier's policies.

4. Inspection and Limited Warranty

Buyer must inspect goods within five (5) days of receipt and report any observable defects. Coming Inflatables, Inc. provides the following warranties:

  • Inflatable bouncers: One (1) years seam-to-seam warranty.
  • Water products and games: One (1) year seam-to-seam warranty.
  • Wear covers like entrance covers or mats are warranted for 90 days.
  • Normal wear and tear is not covered; warranty is voided by misuse, improper handling, or storage.
  • Buyer must use stakes and tie-down tethers to ensure safety.
  • Warranty claims require product inspection at our City of Industry, California factory.

5. Taxes and Duty

Buyer is responsible for all applicable federal, state, and local taxes. International orders are subject to duty and taxes paid by the customer to their respective customs authorities.

6. Disclaimer

Coming Inflatables, Inc. disclaims responsibility for any injury, damage, or loss caused by misuse, negligence, or unauthorized modifications to its products.

7. Copyrights

All logos, product names, trademarks, artwork, literature, photographs, and designs used by Coming Inflatables, Inc. are proprietary and protected by copyright law. Unauthorized reproduction is prohibited.

8. Cancellation

Buyer may cancel orders within 72 hours of placement, subject to cancellation charges. These charges include the price of delivered goods, actual costs incurred, profit, engineering, prototypes, testing, tooling, and reasonable costs associated with the order.

9. Return Policy

All sales are considered final, except as agreed in writing. Returns unrelated to warranty claims are subject to a 25% restocking fee.

10. Insurance

Buyer is required to maintain general liability insurance with a minimum coverage of $1,000,000 for the use or rental of any Coming Inflatables, Inc. products.

11. Governing Law and Jurisdiction

This agreement is governed by California law, and any legal actions shall be submitted to a state or federal court in Los Angeles County, California.

12. Attorney's Fees

The prevailing party in a legal action is entitled to reasonable attorney's fees and costs.

13. Refusal of Service

Coming Inflatables, Inc. reserves the right to refuse service to anyone at any time.
